Texas Electronic Disclosure Notice

This Texas Electronic Disclosure Notice is provided pursuant to Texas Health and Safety Code §181.154. It explains how Dental Gallery may electronically disclose protected health information (“PHI”) for treatment, payment, and healthcare operations. This Notice supplements, but does not replace, Dental Gallery's HIPAA Notice of Privacy Practices.

Dental Gallery creates, receives, maintains, and transmits PHI electronically as part of routine patient care, scheduling, billing, records management, referrals. Electronic PHI may be maintained in electronic health record systems, practice management software, secure messaging platforms, email systems, imaging systems, online scheduling tools, cloud-based services, and other technologies used by the practice.

Texas Health and Safety Code §181.154 generally requires separate authorization before Dental Gallery electronically discloses an individual’s protected health information, unless an exception applies. Separate authorization is not required for certain electronic disclosures to covered entities for treatment, payment, or healthcare operations, or for disclosures otherwise authorized or required by state or federal law. Examples include referrals, provider consultations, laboratory coordination, insurance eligibility verification, claims processing, billing, quality assurance, compliance activities, and other functions necessary to support patient care.

Electronic disclosures may occur through secure electronic health record systems, encrypted email, secure file transfer systems, patient communication platforms, or other methods permitted by law. Dental Gallery uses reasonable administrative, technical, and physical safeguards designed to protect PHI, including access controls, authentication measures, encryption where appropriate, audit logging, workforce training, vendor oversight, and business associate agreements.

This Notice informs you that Texas law permits certain electronic disclosures of PHI for treatment, payment, and healthcare operations without separate written authorization. No action is required, and you are not required to sign this Notice.

You retain all rights provided under HIPAA and applicable Texas privacy laws, including the right to access your health information, request amendments, request confidential communications, obtain copies of records as permitted by law, and request restrictions on certain uses and disclosures of your information.
